As a result of Executive Order 14173, the Trump Administration has made employer DEI programs a central focus of its enforcement agenda. The EEOC and DOJ have issued guidance regarding unlawful DEI and practices that violate Titles VI and VII of the Civil Rights Act, and the Department of Justice announced a Civil Rights Fraud Initiative (special task force) to investigate employers. Federal agencies have sent letters to law firms, entertainment companies, and other entities, and have sidelined potential mergers in the administration's efforts to investigate unlawful DEI practices. Some employers have responded by conducting privileged self-audits to evaluate compliance and identify potential risks. This session will examine the lessons learned from these audits, highlighting the types of issues organizations discovered and the strategies they used to address them. Attendees will gain practical insights into how proactive review can help align DEI initiatives with legal requirements while reducing exposure to regulatory action.
